The Importance of Workers’ Compensation for Contractors

The Importance of Workers’ Compensation for Contractors

Although most states, including New Jersey, require that a business provide workers’ compensation, many do not adhere to it. But the truth is–workers’ compensation is too valuable to dismiss.Risk Management: NYC Crane Owner Cleared of Charges

Just several months ago, Jose Kenn Alexi Cruz Villamar and Robert Wiley of K.C. Tile and Marble were struck by lightning while working at a construction site. Subsequently, Wiley sustained injuries that eventually led to his death.

Upon investigation, the owner, Joel Trujillo was issued a Stop-Work Order for the violation of Florida Statute Chapter 440. Failure to provide adequate workers’ compensation coverage and ignoring a Stop-Work Order culminated to the arrest of Trujillo. According to K.C. Tile and Marble’s CFO Jeff Atwater, “this tragedy is an example of why it is so important for companies to make sure their employees are covered by workers’ compensation insurance.”

This case is neither rare nor hyperbolic; workers’ compensation protects you, your employees and their employees. The fact is—business owners must take a proactive stance in protecting their investment.

Ladders, tiles, heavy machinery; the typical construction site is enveloped in hazards. Although, it’s unfeasible to hazard proof; investing in safety management practices and providing workers’ compensation coverage can give you that peace of mind.

So, why do you need Workers’ Compensation?

It’s the law! Imposed by the State of New Jersey’s Department of Labor and Workforce Development 34:15-1, “when personal injury is caused to an employee by accident arising, out of and in the course of his employment, of which the actual or lawfully imputed negligence of the employer is the natural and proximate cause, he shall receive compensation therefor from his employer…”

The statistics say it all! According to the Bureau of Labor Statistics, the construction industry is responsible for over 720 fatal work injuries; that is approximately 8.9 deaths per 100,000 full-time workers.

It’s your investment! You may not be able to change the environment, but you can ensure that you’re protected in the event that an incident occurs.
